What Is Embezzlement?

Embezzlement is a type of theft offense that involves someone misusing money or property they were entrusted to manage. It often occurs in business, nonprofit and government settings. Common examples include taking company funds, falsifying records or using business accounts for personal expenses.

In Ohio, embezzlement is charged under theft laws. The severity of the charge depends on the amount taken and the relationship between the parties. If the value is high or the victim is elderly or disabled, the penalties increase.

Embezzlement charges at the federal level come into play when the alleged crime involves federal funds, government agencies or interstate transactions. These cases are often investigated by federal law enforcement and prosecuted in the U.S. District Court.

To convict someone of embezzlement, prosecutors must prove that the person had lawful access to the money or property, took it for personal use and intended to deprive the rightful owner. That’s a high bar – and one we know how to challenge.

Penalties For An Embezzlement Conviction

The penalties for embezzlement can be severe. In Ohio, theft of $1,000 or more is a felony. The higher the amount, the more serious the charge. A conviction can lead to prison time, fines, restitution and a permanent criminal record that closes many doors in life.

Federal embezzlement charges carry even steeper consequences. Depending on the amount involved, you could face significant time behind bars in federal prison and hundreds of thousands of dollars in fines. Courts may also order you to repay the full amount taken, plus interest.

Beyond the legal penalties, a conviction can damage your career, finances and reputation. Many of our clients are professionals, business owners or high-level employees. We understand how much you have to lose – and we will work hard to protect it.

Potential Defenses To Embezzlement Charges

Every embezzlement case is different, and so is every defense. In some cases, the issue may be a misunderstanding or accounting error. In others, someone else may have had access to the funds. We’ve also seen cases where the accused had no intent to steal – an essential element the government must prove.

Our criminal defense team looks at every angle. We examine the financial records, interview witnesses and challenge the prosecution’s evidence. If law enforcement violated your rights during the investigation, we’ll fight to have that evidence thrown out.

We also know how to negotiate with prosecutors. Sometimes, we can resolve cases without charges ever being filed. Other times, we push for reduced charges or alternative sentencing. And when trial is the best option, we’re ready. Our lawyers have tried more than 250 cases and handled over 300 federal criminal defense matters. We prepare every case for trial, which often leads to better outcomes in negotiations.
